    Abstract: 結果延後發生涉及的是,侵害結果實際的發生時間晚於行為人原先所預計者,因此屬於一種因果歷程錯誤類型,自von Weber於一八二五年提出概括故意(dolus generalis)之解決方案後,在文獻上多被稱為概括故意之案型。此種案例在刑法上應如何評價,後續各方意見的思辯爭執到現在紛陳而精采,其論爭的興起與流變正是一部「概括故意」的概念史,解決問題的建議方案可以大體歸類為,行為理論、因果理論及相當理論三種,其後逐漸興盛的客觀歸責理論又提供了一個解決方案的切入角度。\\r 本文之主要目的,在於釐清這僵持不下的局面從何而來,藉此評析探討各種學說意見之創見與疑義,並試圖提出己見。首先,本文以國內實務與學說的現況作為討論的出發點,剖析問題核心之所在。接著,探討概括故意這個概念的出現及其所引發的爭論,以追本溯源釐清爭議的來龍去脈。其後,本文將焦點轉移至概括故意理論被放棄之後,德國新興學說的各家爭鳴,藉著對於不同學說的整理與評析,逐一梳理不同解決方案的思考脈絡,比較其中得失,並於最後對於本問題提出淺見,作為學界與實務界之參考。
    The so-called “delayed outcome” in the context of German criminal law refers to the situation in which an outcome resulting from a committed crime takes place later than expected by the criminal. Therefore, the delayed outcome not only belongs to the category of causal errors in light of academic debates, but also serves as a typical case of the so-called dolus generalis, which was advocated and developed by von Weber in 1825. Due to its significance for the theoretical and practical developments of dolus generalis, the problematic of delayed outcome has triggered numerous controversies and discussions, which has then resulted in the categorization of different theories of intention. Moreover, the development of the so-called objective imputation can also be traced back to the debates on the delayed outcome. In view of the endless controversies thus far engendered, this essay intends to undertake a comprehensive review of the historical, theoretical as well as practical developments of the “delayed outcome” and in this way tries to figure out how the cases of delayed outcome should be analyzed and resolved in criminal law. In addition to a comparative and a dogmatic study of German criminal law theory, especially of the development of dolus generalis, this essay also attempts to critically examine the related discussions on “delayed outcome” in Taiwan so as to provide some constructive suggestions to the Taiwanese theoretical and practical developments.
