    题名: 試論公共工程聯合承攬之規範與實務應用現狀

    摘要: 聯合承攬制度在我國工程採購上已使用數十年，此制度多適用於規模龐大、造價高昂或含有特殊技術的工程。由於聯合承攬是由兩名以上廠商合作組成，其間之權利義務歸屬等法律關係較一般型態之承攬更為複雜，因此研究如何增進及完善現行制度即為一項重要課題。
    鑒於我國所稱之「聯合承攬制度」與外國「Joint Venture」所指內容並非完全相同，故本文討論範圍僅限於工程承攬相關範圍。本研究旨在探討聯合承攬規範於我國實務上的運用與影響，透過檢析學說對聯合承攬制度的定性及過去實務見解的演變，分析我國實務上對聯合承攬的認知與規範制度上存在的差異。
    研究結果表明，無論在學說或是實務上，都存在對聯合承攬定義、責任義務歸屬與相關制度的混用與誤解。總結而言，目前之規範仍有未盡周全之失，且並未全面落實，缺乏違反規範時相應之處理方式與懲戒規則。這些爭議強調了完善聯合承攬制度的重要性，期望本研究對於我國制度之發展能提供參考。
    The joint venture system has been used in engineering procurement in our country for decades, particularly for large-scale, high-cost projects or those involving special technologies. Since joint venture involves cooperation between two or more contractors, the legal relationships regarding rights and obligations are more complex than in general contracting. Therefore, studying how to improve and enhance the current system is a significant issue.

    Given that the term "joint venture system" in our country does not entirely correspond to the "Joint Venture" concept abroad, this paper focuses solely on issues related to engineering contracting. This study aims to explore the application and impact of joint venture regulations in practice in our country. By examining theoretical perspectives on the characterization of joint venture systems and the evolution of past practical views, this study analyzes the differences in understanding and regulatory systems of joint venture in practice.

    The results show that there are misunderstandings and misapplications regarding the definition of joint venture, the attribution of responsibilities and obligations, and related systems, both in theory and practice. In summary, the current regulations are still incomplete and not fully implemented, lacking appropriate handling measures and disciplinary rules for violations. These issues underscore the importance of improving the joint venture system, and it is hoped that this study can provide some reference for the development of our country's system.
