Since Taiwan adopted hearsay, Article 159-1 of the ROC Criminal Procedure Code goes much beyond hearsay exceptions of Anglo-American hearsay, which has resulted in academic criticism of confrontation-right violations. Even the Grand Justice Interpretation No. 582 already excludes that article from out-of-court statements made by the co-conspirator; the Supreme Court opines different viewpoints on this point. In addition to analyzing cases of the Supreme Court, this study searches for the rationale of hearsay exception of the ROC Criminal Procedure Code based on the development of hearsay in the Anglo-American legal system.
