    Abstract: 借用他人土地建屋的情形,土地與土地上之房屋,自始即非屬同一人所有,當事人之間僅有債之關係之使用借貸契約作為利用權源,當嗣後有一方將其標的物之所有權讓與第三人時,基於使用借貸契約的相對性,房地分離下的產權衝突再度發生,究竟土地所有人可否對房屋所有人訴訟拆屋還地,是近來實務上的重要爭議問題,基於房屋的價值性與社會經濟利益,法院試圖調和房地所有人之利害關係,從類推適用租賃之規定,到援引誠信原則與權利濫用禁止作為解決問題之依據,均可見法院努力上的用心,學說上對此也尚未有一致共識。本文從實務判決與學說意見,討論處理本爭議問題的法律適用。基於私法自治,對於房地分離嗣後處分之風險,不管是土地讓與還是房屋讓與,當事人都還有預為防免的可能性,因此,有無法律保護的急迫性,非無疑問,故應儘量減少法院介入的空間,予以例外從嚴。
