    Title: 破產之國際效力之研究

    Abstract: 由於交通之發達，世界各國通商頻繁，內外國人錯綜居住，各營其業，一國國民在他國設立公司，或一國國民之財產涉及數國者，已成為今日之普遍現象，因此，當一國宣告某人破產時，對於破產者在他國之財產有何影響，即成為當今國際通商所面臨之重要課題。對此問題，世界各國立法歧異，而已經訂立之條約因限於某特定區域，亦乏效果。假使破產發生地之國家與破產人之財產所在地國家無約定存在，且各持己見，則來自其他國家之債權人即可能遭受不利，結果造成國際間商人裹足不前，故為謀求國際經濟與商業活動之和諧發展，奠定人民密切聯合之基礎，本論文即就此項問題歸納整理，期能對達成破產國際效力一致之目的有所助益。
