    Abstract: 我國行政訴訟法自 2000 年實施修正新制迄今,在制度運作上與往昔制度相比,對 人民權利之保障已有大幅進步,但近年來由於我國社會經濟政治各方面情況受到內外 影響而快速發展,從先前的研究成果與近年幾則重要的行政法院判決當中,發現我國 行政訴訟制度當中,關於訴訟權能、權利保護必要性、暫時權利保護措施與判決遵行 確保制度,實有進行全面性實務判決研究與比較法分析之價值與必要。儘管德國相關 法制向為我國行政訴訟之主要繼受對象,但同採公私二元制的法國,在 2000 年 5 月將 長期以來的行政法院判例與各自分立之相關法規編修為行政訴訟法典,尤其其中新增 詳細的暫時權利保護制度與判決執行確保制度,對於我國實效有限的暫時權利保護制 度,與行政機關不尊重或不遵守行政法院判決的情況,或能提供另一角度的可能建議。 因此,本計劃希望以三年為期,探討分析我國 2000 年行政訴訟法新制實施後,關 於訴訟權能、權利保護必要性、暫時權利保護措施與判決遵行確保制度之實際運作情 況,並且援引法國行政訴訟制度作為比較研究之對象。而本研究之重要性在於,以我 國實務運作之判決為本,藉由法國行政訴訟制度運作與學理思維提出不同的觀察角度, 補充並豐富我國此部份比較法之研究成果,更進一步探尋適合我國制度之設計方向。
    The new Administrative Litigation Act was launched in 2000 in Taiwan. So far the new system has provided substantial progress in protecting people’s rights. However, due to rapid changes in socioeconomic and political environment, the Administrative Litigation system still needs improvements in certain areas, such as the Standing, the needs of legal protection, the interim relief and the enforcement of judgments. Although the German law has always been our major reference object, this study will use the French administrative litigation system as the comparative object. In 2001, a new Administrative Litigation Act was launched in France. In their new act, there are many new articles covering the interim relief and the enforcement of judgments that could provide some insights into our legal system in Taiwan. This research is a 3-year study aiming to explore and analyze the actual operation after implementing the new Administrative Litigation Act since 2000, and also compare to the French administrative litigation system and administrative court’s decisions. Based on the findings, this research will provide some suggestions which may contribute to improve the Administrative Litigation system and the protection of human right in Taiwan.
