    Title: 論“情勢變遷原則”在中國外交史中的運用

    Abstract: 到目前為止,有關近代中國擺脫條約束縛歷程的詮釋典範,是強調“廢除不平等條約”的革命外交史觀。“革命史”將是否主張無條件“廢除不平等條約”作為愛國主義和反革命、好和壞的分水嶺;著重於是誰最早提出並堅持“廢約”,歌頌不與列強妥協的革命精神,批評主張“修約”者為賣國。因而,迄今中國外交史與其他國家外交史的研究取向不盡相同,偏重於依賴民意的對外抗爭歷程,貶抑依循國際慣例的正常交涉,②一般國家正規外交史注重的外交交涉與國際法的聯結,法理觀念的發展與國家實踐的歷程在中國外交史學界長期遭到忽視。在此研究典範之下,兩岸學界對修約史的個案研究雖為數不少,但未見有系統的研究,亦欠缺全面性的詮釋。
