    Title: 都市更新投資信託可行性之研議及其對房地產參與角色的影響

    Abstract: 國內都市更新推動已久,但卻一直成就有限。雖然在民國87年都後市更新條例與相關子法相繼通過,解決許多實務推動上的困境,但在都市更新投資信託公司部分,由於公司設置與基金運用子法上一些問題與限制,公私部門若要以投資信託方式推動都市更新,事實上是存有極大的困難,所以至今無一家都市更新投資信託公司成立,因而失去原先立法目的。本研究首先探討在目前法令下,推動都市更新以投資信託方式籌募資金之困難點,並針對這些問題,提出幾點因應方向。本研究另設計幾種實際推動之可行機制,進而分析若行政院提出之不動產證券化條例草案能立法通過,都市更新投資信託該如何進行,最後並分析都市更新若能證券化,對國內房地產業和相關參與者會有何影響,包括正面的效益與所面臨之風險。
