    摘要: 全球化及網絡化的快速變遷社會,尋找法律新典範,日益受到法學界的重視。本文是作者在這個方向上的努力。本文首先介紹索倫教授所提出的德行法理學,並進一步闡述德握金整全性理論,可以在德行法理學中,扮演更重要的角色。然而,德握金理論過於著重法官的內在觀點,沒有富勒人際交往的理論協助,也無法發展出完整的德行法理,本文因而進一步,藉由柏拉圖正義及德行的主張,由柏拉圖政治家篇對話路做為起點,試著勾畫出以柏拉圖正義理念為基礎,協調德握金與富勒的理論,發展出德行法理的可能。
    In a fast changing globalized world and further networked society, a new legal paradigm is actively pursued by ever increasing legal scholars. This article introduces first Lawrence Solum’s virtual jurisprudence and points out that Dworkin’s idea of integrity should have a more positive role in virtual jurisprudence. However, the internal legal point of view of Dworkin also needs to be further integrated with the human interactive theories of Lon Fuller. Starting with Plato’s dialog, Statesman, this paper sketches a preliminary plan to construct a theory of virtual jurisprudence, placing in its core Plato’s idea of justice as virtue.
