    Abstract: 影響我國個人資料保護法修正內容甚深之1995 年歐盟資料保護指令(95/46/EC)即將 於2012 年進行修正。由於歐盟在全球個人資料保護領域之領導地位,此一修法工作已 引起各國之高度關注。 在目前已知之修正內容中,賦予資料主體得以在資料管理者無正當理由保存相關資 料之情形下,請求後者移除/刪除個人不欲再為人知之資訊,並被社會所遺忘之「請求移 除之權利(the right to be forgotten)」(或稱為「被遺忘之權利」),實為焦點中之焦點。固 然,上述權利之實踐有助於個人資料之自主控制,但其也可能阻礙資訊之自由流通,更 可能造成言論自由之侵害。因此,如何尋求上述各項權利之平衡點,已成為熱門之研究 議題。除「請求移除之權利」外,歐盟資料保護指令之其他修正內容,諸如:指令適用 範圍之擴大、個人資料可攜、資料管理者進行隱私影響評估之義務等,亦值得加以研究。 本計畫之目的除在深入瞭解「請求移除之權利」之輪廓及其可能引發之爭議外,更 將擴及歐盟資料保護指令即將進行之其他重大修正,期能早一步掌握歐盟個人資料保護 法制之最新修正方向,俾供將來學術討論及實務參考。
    The 1995 EU Data Protection Directive (95/46/EC), which has greatly influenced on the recently-passed Taiwanese Personal Data Protection Act, will undergo a major update starting in 2012. Due to the leading role of European Union in the field of data protection, the amendment of the Directive has attracted attention around the world. Among all the known amendments, the focus is on “the right to be forgotten,” which empowers data subjects to delete their personal data any time they want, where there are no other legitimate grounds for a data controller to keep their data any longer. Although such right will no doubt enhance data subjects’ autonomous control over their personal information, it may also block the free flow of information or even interfere with data controller’s right to free speech. How to strike a proper balance among relevant interests, thus, becomes a hot issue. In addition to the right to be forgotten, other important amendment proposals (e.g., making the Directive applicable to all services targeting EU customers, the issue of data portability, the obligation of data controllers to conduct privacy impact assessment) are also worthy studying. This research project aims to comprehensively study the right to be forgotten and its potential conflicts with freedom of information and freedom of expression. Moreover, this project will thoroughly review other key amendments to the EU Data Protection Directive in the hope to provide suggestions for law enforcement and further discussion in this field.
