    Abstract: 韓國兩位前總統全斗煥、盧泰愚以軍事叛亂、內亂等罪嫌受到司法審判，引起世人的關注。此案背景十分複雜，且帶有濃厚的政治色彩。本文則是從憲法、形法的觀點去探討此一案件，從內亂罪的法律責任、公訴時效等層面去分析被告行為的違法性以及司法處理的可行性。同時，本文指出此事件對於韓國民主法治之確立所具有的正面意義。即，做為一個歷史教訓，告訴後人：任何對於民主憲法秩序的破壞行為，都不會得到認同，並且必將受到制裁。也唯有當此一觀念為全體國民所確信，才能保證民主體制的永續發展。
