    Title: 中央三級機關(署、局)組織運作及二級機關對其指揮監督之研究

    Abstract: 依照行政院組織基準法第三十三條第四項所示:「(中央三級機關)署、局之總數除地方分支機關外,以七十個為限」;又依2009年5月25日訂頒的「行政院及所屬各機關組織調整作業原則」中對於「中央三級機關(署、局)規劃原則」之規定:「三級機關名稱為『署』或『局』,『署』用於業務性質與職掌或別於本部,兼具政策與執行之專門性或技術性機關;『局』用於部所擬定政策之全國或轄區執行機關。」然而,從組織設計角度來看,民國101年將要開始運作的形政院新組織,起碼面對三項中央二、三級機關之間的運作問題:第一,二級機關之「司(處)」與三級機關的「局」之間指揮與合作關係的問題;第二,二級機關之「司(處)」與「署」之政策規劃統合之間可能的決策不一致問題;以及第三,「司(處)」與「局」分別擔任政策制訂與政策執行的分工整合問題,均為本研究之研究主題。本研究將採取文獻回顧、深度訪談、焦點團體、以及問卷調查等四個方法,來回答前述的三個研究問題,並且挑選並引進美國、瑞典、與南韓等三個國家的相關經驗,於本土經驗研究的結果進行對話,以期能對我國將要開始的新式行政院組織在二、三級機關之間的互動設計,提出有意義的實物看法。 According to the item 4 of the article 33 in the “Basic Code Governing Central Administrative Agencies Organizations,” the total number of administrations and bureaus which belong to the level-three agencies in central government, except regional branches, should not exceed 70. Moreover, according to the “Adjustment and Operation Principles for Executive Yuan and Its Affiliated Agencies”, enacted on May 25, 2009, in which the “Plan Principles of Level-three Agencies” regulates that the level-three agencies should name after either “administration” or “bureaus”. Administrations are only in charge of professional functions to cope with policy implementation. And, bureaus are executive agencies with catch-all jurisdictions. They are responsible of both policy formulation and implementation under the oversight of the Ministries. However, from the perspective of organization design, the new structure of Executive Yuan which will operate in 2011 will face three operating problem between the level-two and level-three agencies: First, the problem of the command and collaboration between the level-two agencies (departments) of the Ministriesand level-three agencies of bureaus. Second, policy planning and coordination between and within the level-three and level-two agencies could lead to the dilemma of policy inconsistencies; and third, there is a practical needs to understand and re-design the proper command and control interactions between the level-three and level-two agencies. Totally four research methods will be used in this research: literature review (comparative studies on the US, Sweden, and South Korea), In-depth interviews, focus group interviews and questionnaire survey to answer the three research questions foresaid. The results of this research will provide practical suggestions for the organization interaction and structure design between level-two and level-three agencies in the future.
