    Abstract: 2008 年2 月17 日,科索伏臨時議會宣布獨立,在國際間引起重大的爭議。美國和歐盟多數成員支持科索伏,認為科索伏的獨立是解決科索伏與塞維亞兩民族間長久衝突的最後手段。以俄羅斯和塞維亞為主的反對陣營則主張科索伏為塞維亞共和國之一部份,科索伏單方宣布獨立的行為,既違反國際法尊重國家領土與主權完整的原則,亦不符合1999 年聯合國安理會第1244 號之相關決議,應屬無效。2008 年10 月,聯合國大會通過決議,將科索伏單方宣布獨立之行為是否符合國際法的問題,交付國際法院提供諮詢意見。科索伏獨立合法性爭議,重啟了國際法中,關於國家形成要件、程序該當性,以及國家承認的性質與效力等國際公法基本理論的討論。本計畫擬對科索伏爭議中出現有關這些理論的法律問題進行深度分析,並從國家間對於此案的相關法律論辯,國際法院最後對此爭議之見解,以及國際社會最後如何解決科索伏國家地位問題,探討科索伏爭議對國際法理論發展之影響。
    On 17 February 2008, the Assembly of the provisional Kosovo authorities declared Kosovo as an independent and sovereign state, which provoked controversy within the international community. The United States and other countries supporting Kosovo’s move took the view that independence was the last resort for putting an end to the long-standing conflict between Serbia and Kosovo. Those in the opposing camp, especially Russia and Serbia, argued that Kosovo’s unilateral declaration of independence violated the international law principle on the respect for territorial and sovereign integrity of states as well as United Nations Security Council Resolution 1244 of 1999, and should be “null and void”. In October 2008, the UN General Assembly adopted a resolution to refer the question of the legality of Kosovo’s unilateral declaration on independence to the International Court of Justice for an advisory opinion. The Kosovo independence controversy has re-opened the fundamental theories of public international law relating to the requirements for statehood, the legitimate procedure of the creation of states, and the nature and function of recognition of states. This research intends to conduct a thorough analysis on these theoretical issues. In addition, by examining the relevant legal debates between states, the World Court’s advisory opinion, and how the international community subsequently proceeds to resolve Kosovo’s pending statehood, it will assess how the Kosovo independence controversy impacts on the development of international law.
