    摘要: 被害人或目擊證人指證以確認實行犯罪之行為人，可說是刑事訴訟偵查實務中不可或缺 的重要蒐證方法，並常為法院判決被告有罪之重要證據，我國偵查實務常見的包括真人 指認、相片指認、錄影帶指認以及聲音指認等不同方式。但指認人除了可能受其本身觀 察能力、記憶能力及真誠性之不確定因素影響外，許多指認之實施帶有強烈暗示性，證 人常受影響以致指證錯誤之情形屢屢發生，此外，指認程序涉及相關人民基本權利之限 制、指認結果對真實發現的助益或影響以及指認之不可重覆性等問題，在法治國的刑事 訴訟下，如何確保偵查中指認程序之合理、正當，自不容輕忽。本計畫將以偵查中指認 作為研究的重心，研究範圍包括（一）我國偵查實務實施指認之現況（二）受指認人， 亦即被告或犯罪嫌疑人之權利與義務，（三）指認者之權利與義務，例如相關證人之權 利義務，（四）指認實施之法律基礎與執行措施以及（五）對於指認之證據調查與證據 評價等與指認程序密切相關的問題。預計研究項目包括： 一、我國偵查實務實施指認之現況分析 二、指認在心理學上之討論 三、指認之方式 四、指認之法律基礎 五、指認之程序與參與者之權利義務 六、指認時之強制措施 七、指認之證據價值 八、修法建議與具體條文試擬。

But mean and recognize people except that may be influenced by its one`s own observation ability , memory ability and sincere uncertain factor, a lot of point the implementation that admit there are strong hints, the witness is often influenced to accuses the wrong situation of and takes place repeatedly, in addition is it admit procedure involve relevant people restriction of fundamental right , is it admit result is it or influence and point to true find admit can`t person who cover question again to benefit to point to point, under criminal suit that the law runs a country, it is rational , proper how to guarantee to investigate the middle finger to recognize the procedure, it is indiscreet and negligent not to allow by oneself. Plan with investigate middle finger recognize as weight that study originally, research range include our country investigate real to construct present situation (2 ) recognized to point is it recognize people to mean while being practical, namely the right and obligation of the defendant or the suspect, (3) Mean the right and obligation of the persons who recognize , such as relevant witnesses` rights and obligations, (4) It point it admit implement it is legal foundation and the executive measure and (5) investigate with evaluation of evidential matter,etc. and not pointing not for problem that procedure closely related withing for evidence admitted to point. Combine it because of the conclusion of studying finally, under the current criminal suit structure , offer the suggestion of legislating.
