    Abstract: 世界民主先進國家對媒體的內容都給予相當自由與自主的空間,但是有些媒體會濫用自由而缺乏自律及該有的問責態度。所以主管機關對媒體內容與廣告都面臨「不管」 (no-regulation)、「自律」(self-regulation)、「共管」(co-regulation)及「管制」(regulation) 的選擇。我國國家通訊傳播委員會自從2006 年2 月設立以來,對媒體的新聞、節目與廣告的管制方式,常常遭致外界批評。歐盟於2001 年的白皮書就提出「共管」的概念,但是國內的業界及主管機關對其正確定義及概念仍舊非常模糊,學術界極有必要做相關探討。所以本研究在第一年要探討如何平衡「自律」、「共管」及「管制」,而且要建議適合國內生態的共管制度。此外,設置新聞公評人(ombudsman)也是媒體自律的一種自我實踐方式,但是因為文獻指出,業者認為考量經濟因素,現階段不會設置,即便公共電視也表示同樣的態度。所以,本研究希望在第二年,也就是第二階段,集中在公評人的討論,希望藉由本研究客觀的探討與分析,瞭解國內實施公評人制度的困境,本研究也會就國內如何推動實施新聞公評人制度提出具體建議。研究方法包括文獻分析、深度訪談、焦點團體座談、問卷調查。
    The media play an important role in disseminating information to the public and should enjoy a great degree of freedom and autonomy. However, some of the media are blamed for their program, news or advertisement as not accountable to the public. For the regulators, they are facing the regulatory choices such as “no-regulation”, “self-regulation,” “co-regulation” and “regulation.” The National Communications Commission in Taiwan has been criticized for its regulation towards the media since its establishment in 2006. European Commission’s White Paper in 2001 proposed the idea of “co-regulation” which is considered as a better regulatory choice. However, it is still a vague concept for Taiwan’s industry, regulator and the academic community. With regard of “news ombudsman,” it is one form of self-regulation adopted by some media abroad. It may be an effective self-regulation in Taiwan. Therefore, for the first year, the purpose of the study is to discuss how to establish the “co-regulation” system in Taiwan and how to make a balance among self-regulation, co-regulation, and regulation. In the second year, the purpose of the study focuses on the feasibility of establishing the news ombudsman system in the electronic media. It will review the practices abroad and give recommendations to the media and regulator in Taiwan. Since there is insufficient literature regarding co-regulation and ombudsman in Taiwan, this study can contribute to the domestic literature. The research methods include literature review, in-depth interviews, focus groups, and questionnaires.
