Abstract: | 本研究內容在探討分析抗戰前十年(1928-1937)的出版法規。1914年國民政府公布「出版法」,至1926年廢止。1930年12月16日國民政府公布了新制訂的「出版法」,1931年10月7日內政部公布了「出版法施行細則」。本研究的主體即在析論1930年的出版法和1931年的出版法施行細則。1930年的出版法呈現出兩個特質:黨政一體、黨政雙軌並行。當時,國民政府最關心的是如何遏止共產思想和反國民黨的言論流傳,所以在出版法和出版法施行細則中都可以看出主導出版品審查工作的是是中國國民黨黨部,中央和地方政府機關配合執行。1930年的出版法實質重點有二:一在對出版物和出版者的行政管理規定,一在禁止反政府、返中國國民黨、反三民主義的出版物出版與發行。該法看不到對出版人與出版事業基本權益的保護條款,更未有對優良出版人與出版事業予以獎勵的文字,所以,該法的精神在「禁止」而不在「促進」。 The publication regulations during the decade (1928-1937) before the Sino-Japanese War will be discussed in this research. In 1914, the National Government promulgated the Law of Publication, which was canceled in 1926. The Government promulgated the revised Law of Publication on Dec. 16, 1930, the Ministry of the Interior also promulgated the Detailed Regulations of the Law of Publication on Oct. 7, 1931. The analysis and discussion of the Law of Publication in 1930 and the Detailed Regulations of the Law of Publication in 1930 will be the main body of this research. There were two specialties in the Law of Publication in 1930. One was the union of the political party, the Kuomintang, and the Government. The other was the two did both at the same time and did not interface with one another. How to stop the spread of the communistic thought and the public opinion which against Kuomintang was the Government concerned most. In the Law of Publication and the Detailed Regulations of the Law of Publication, we could find the inspection was directed by the Kuomintang, and executed by the central and local government. There were two essentials in the Law of Publication in 1930. One was the rules for the administration management of the publications and publishers. The other was to forbid publishing those publications that were against the Government, the Kuomintang, and the Three People’s Principles. There was no protective rules for the essential benefits of the publishers and publishing business, and also no award texts for the excellent publishers and publishing business. The central idea in this law was to forbid, but not to promote. |
