    摘要: 公平交易法於八十八年二月修正公布後，修正原本第四十六條之除外規定，而將該法提升至經濟憲法之地位。如此時代性的宣示，雖和當前重視競爭政策的潮流相為呼應，但在經濟法的領域中，競爭政策、管制政策、貿易政策，原即應各有其分際，而處於一種緊張的均衡，前者雖然反映著某種時代精神，但並不必然意味著扮演經濟憲法的角色。經濟活動的外部效果，公共財產的存在，交易資訊及成本的不對等等事實，恐怕多不是競爭政策所能解決的。 本研究計劃擬參酌美日德等國類同我國公平法第四十六條的除外規定做比較法的研究，檢視該條的體制功能，並就公平法第一條所揭本法立法意旨六字為具體探析，同時考量公平法第九條管轄競合之規定，企圖確立一明確的適用準則，使競爭政策與其他產業政策各司其職，以維真正的經濟利益。 This research project studies the relationship between policies for competition and regulation. The Article 46 of Fair Trade Law, amended on 3rd Feb, 1999, had expressly asserted that all the competitive practices regulated by other laws will by allowed under the Fair Trade Law only without conflicting with its` legislative purpose; in other words such an amendment declared itself as the Constitution for all the economic practices. Just as what we have well understood that the line between competition and regulation must been drawn, and the policies of competition are not necessary superior to those of regulation for promoting equity efficiency or welfare. In the program we will try o find out the line by discussing the purpose of the Fair Trade Law and studying the attitude of other advanced states for establishing a clear rule to apply the article in issue.
