    Title: 法國與歐洲共同移民政策
    France and European Immigration Policy

    Abstract: 法國與歐洲共同移民政策的規範目的相似,但是內容不同。其相同點在於法國與歐盟對於歐盟內部移民或會員國國民皆是採取包容的政策型態,而對於歐盟外來者或第三國人民則以排斥政策及限制條件對待。不過探究兩者的移民規範細節後卻能發現尚存許多相異之處,因此即使法國在歐盟整合移民政策的過程中係為主要的協調國之一,法國的移民政策仍不必然引導著歐洲共同移民的方針,且為歐洲共同移民政策模仿的範本。再者由於歐盟移民政策的整合過程並非是一國促成,法國必須與其他會員國協商及尊重歐盟超國家機構的決定。在多層次移民治理的模式下,國家不是唯一的決策行為者,超國家機構與非政府組織亦將納入考量。因而法國可能對歐洲移民政策持續具有影響力,但是仍須與其他行為者協調,無法單獨主導政策發展。
