    Abstract: 本文審視人工智慧對競爭法造成的衝擊,歸結為訂價演算法與生成式人工智慧兩大區塊,首先快速檢視生成式人工智慧所涉及的競爭法議題,繼而將主要重點置於訂價演算法對市場競爭所造成轉變及其引發的同業勾結之上。經由訂價演算法功能分類及今後可能出現的演算法勾結情境交叉勾勒描繪,演算法憑藉價格監視與自動訂價功能,以及持續進化的策略計算與即時反應能力,致使同業價格勾結之頻率與範圍出現明顯提升,其可能性已經躍然紙上。透過演算法從事的聯合行為雖然更加隱晦,然而演算法倘若自學開發聯合行為,部署使用廠商及訓練開發業者應當為之共同承擔違法責任。此外,暗默勾結原不違反競爭法,但卻弱化市場競爭,訂價演算法使之更為普遍。全面性禁止演算法從事暗默勾結,在技術上雖屬可行,但就當前競爭法規範而言似乎過於冒進。不過對於不跟進漲價的同業施以殺價競爭,乃是促成暗默勾結的重要手段,應可依據公平交易法第20條第4款予以禁止,以降低訂價演算法參與暗默勾結的壓力及誘因。
