    摘要: 本論文比較分析日本與南韓在爭取同性婚姻合法化過程中,法律、政治與文化因素的交互作用。本文採用「結構—能動者」(structure–agent)分析框架,探討制度性限制、宗教影響、政黨政治與公民規範,如何與行動者的策略與法律動員互動。研究方法包括訪談兩國的 LGBTQ+ 組織,以及對媒體報導的論述分析。研究結果指出,日本呈現出一種制度性惰性,而南韓則面臨積極的意識形態反對。儘管兩國在社會支持度上皆有所提升,立法進展卻仍陷於停滯。兩地運動發展出不同的策略:日本的行動者傾向於透過訴訟與審慎訊息來說服菁英;南韓的行動者則採取聯盟建立、以權利為基礎的論述,以及對抗性的法律策略,以應對組織化的福音派抵制。本文主張,單憑社會輿論並不足以推動法律改革;真正關鍵在於結構僵化與行動能動性之間的互動關係,這將決定改革的速度與方向。本研究有助於深化對東亞民主國家中 LGBTQ+ 權益運動的策略與制度動態之學術理解。
    This thesis offers a comparative analysis of the legal, political, and cultural factors shaping the struggle for same-sex marriage in Japan and South Korea. Using a structure–agent analytical framework, it explores how institutional constraints, religious influence, party politics, and civic norms interact with activist strategies and legal mobilization. Based on interviews with LGBTQ+ organizations in both countries and discourse analysis of media coverage, the study highlights the contrasting dynamics of passive structural inertia in Japan and active ideological opposition in South Korea. While both countries face legislative stagnation despite rising public support, their movements have developed distinct approaches: Japan’s activists emphasize litigation and elite persuasion through cautious messaging, whereas South Korea’s activists engage in coalition-building, rights-based framing, and confrontational legal tactics amid organized evangelical resistance. The thesis argues that public opinion alone is insufficient to drive legal reform; rather, it is the interplay between structural rigidity and activist agency that defines the pace and trajectory of progress. These findings contribute to scholarly understanding of activist strategies and structural dynamics in East Asian democracies.
