    Abstract: 本計畫藉由類型化案例分析及比較法分析，檢視目前法院對於借名投保之法律關係認定是否妥適，並研究保險利益原則對借名投保之影響。研究成果預期將能有效解決保險實務銷售端、理賠端之爭議外，更能解決目前法院判決對於借名投保內外部效力莫衷一是之情形，以維護金融保險法律關係之安定。
