    Title: 國外人身保險給付強制執行與受益人介入權之法制與實務運作

    Abstract: 債權人就債務人之財產聲請強制執行時,「解約金得否作為強制執行之標的」以及「執行法院能否核發執行命令逕予終止債務人為要保人之人壽保險契約,命第三人保險公司償付解約金?」是近十餘年司法實務上極具爭議性之問題 ,晚近最高法院肯定解約金之強制執行適格性 ,並經最高法院108年度台抗大字第897號民事裁定肯認「執行法院於必要時,得核發執行命令終止債務人為要保人之人壽保險契約,命第三人保險公司償付解約金。」,惟為兼顧債權實現與受益人潛在利益的保障,比較法上有賦予受益人介入保險契約之權,容許其提出相當於解約金之金額,阻止法院對解約金為強制執行。此等立法是否值得我國參考採納?若予採納,宜如何設計,有加以研究闡釋之必要。
    Taiwan Supreme Court makes Tai Kang Da Zi No. 897(2019) decision on December 9, 2022, considering the intervention right in Switzerland, Austria, Germany, and Japan, and holds that the rights of the debtor in the enforcement of the life insurance contract by the executive court should take into account the chosen enforcement method, which should contribute to the achievement of the purpose of enforcement. Consequently, the Court adopted the conclusion of compulsory enforcement of life insurance surrender value. Based on the aforementioned decision of the Supreme Court, this research project (hereinafter referred to as "this study") reviews recent Taiwan judicial decisions on the issue of compulsory enforcement of life insurance surrender value. It confirms that there is no significant controversy in Taiwan's courts regarding the conclusion of compulsory
    enforcement of life insurance surrender value. The court decisions of Austria, Germany, and Japan align with the conclusion of the Supreme Court, all affirming the compulsory enforcement of life insurance surrender value. Therefore, this study further introduces the intervention right in these three countries, aiming to prevent adverse consequences on the parties of the insurance contract resulting from the compulsory enforcement of life insurance surrender value. These systems grant the
    parties the right to intervene to maintain the continuation of the life insurance contract. Following a comprehensive analysis of the pros and cons of introducing the intervention right into Taiwan, this study proposes draft provisions for the intervention right that are suitable for the existing Taiwan legal framework. However, this study adopts a cautious stance towards the lawmaking of the intervention right. This is because under the current legal framework without the intervention right, parties of the insurance contract can independently settle the debt with the creditor. This enables them to avoid the life insurance contract will be terminated early. Nevertheless, it is important to note that the current legal framework lacks sufficient protection for the parties of the insurance contract.
