    Abstract: 立法院修正通過行政訴訟法都市計畫審查程序章時，曾針對先行區段徵收為附帶決議表示：「內政部應於行政訴訟法都市計畫審查程序章修正施行後，檢討先行區段徵收制度是否有調整或改善的空間」及「請司法院、內政部對本章規定施行後三年內，觀察實務之發展，分別對其主管之法規是否有修正之必要，適時進行檢討與修正」，從此可見先行區段徵收的問題在法制度上應如何修正，實有重要性及急迫性。本計畫預計從計畫與徵收之關係，細緻盤點先行區段徵收在學理上及實務上的問題，以提出法制度上修正建議(包括是否應修正都市計畫法、土地徵收條例及區段徵收實施辦法等)作為目的，對計畫與徵收法學及實務應能有一定之貢獻。
