Title:	強制汽車責任保險給付與國家賠償責任之扣抵──臺灣新北地方法院111年度國字第23號民事判決

Abstract:	當汽車交通事故同時涉及國家賠償責任或其他原因之賠償義務時，受害人受領強制汽車責任保險之給付者，國家賠償義務機關因非強制車險之被保險人，固然不能因保險給付而減輕責任。但當被保險人與賠償義務機關成立連帶責任時，保險給付會因民法第 274 條規定，使賠償義務機關同免責任，並有強制汽車責任保險法第 33 條第 1 項保險代位規定之適用。若被保險人無責，保險人與賠償義務機關為不真正連帶債務關係。此時應視受害人損害是否會獲得重複補償，以決定是否類推適用民法第 274 條使賠償義務機關同免責任。
