    Abstract: 鑑於抗體相關發明專利申請之困境,以及發明創新鼓勵之必要,同時顧及專利權公示性與正當性,本文提議專利「可據以實現要件」之「部分遞延檢驗」的構想,將專利權支配範圍與「可據以實現要件」結合,令二者同一命運。在專利申請時,「可據以實現要件」之審查,僅針對專利說明書所揭示結構之抗體為中心,不及於其他例示外之抗體類型。然而,專利權授予後,一旦專利權人對於專利說明書例示以外之抗體類型,主張專利權時,無論是授權或侵權救濟,須先證明此抗體於專利申請日之時點乃符合「可據以實現要件」,方能將此抗體納入專利權範圍加以行使。
