    摘要: 為排除與矯正學生之偏差行為，使之合乎社會規範，學生懲戒制度遂成為學校教育不可或缺的一環。本文即以影響我國教育極為深遠的美國學生懲戒制度為研究對象，並以美國法院判例為主，試圖從其中歸納出法院處理學生懲戒問題的法律原則。在研究架構上，首先說明懲戒的原則，接著分就停學、懲戒性轉學、學業制裁和體罰等主要懲戒類型與實施程序加以探討。最後，本文就懲戒權之明確授與、正當程序之執行和體罰之存廢三部分提出建議，以提供我國在制定學生懲戒規定或修法時的參考。
