    摘要: 氣候變遷法為近年法學界研究的重點領域之一，我國目前相關最重要的法制為溫室氣體減量及管理法。2021年10月環保署提出修正草案，全文修正並更名為氣候變遷因應法，大幅變更原法制中的計畫體系。氣候變遷計畫作為政府因應措施及進行管制的依據，應具備一定拘束效力，更為外界關心並爭議的重點，然此部分並非學界近年來的研究重點。本研究擬由計畫法的角度，對於我國氣候變遷計畫法制進行較深入的觀察，並透過對德國氣候保護法計畫體系及聯邦憲法法院2021年3月24日裁判見解的觀察，以建立氣候變遷計畫法的理解及論述。透過相關比較研究，期能建構我國氣候變遷計畫法制較完整的體系論述，亦期有助於我國氣候變遷計畫司法審查的發展。
