    Title: 論貿易便捷化措施於區域貿易協定下之最惠國待遇問題
    A Study on Issues Regarding Most-Favoured-Nation Treatment of Trade Facilitation Measures under Regional Trade Agreements

    Abstract: 近年來,區域貿易協定之訂定日漸普遍,各國積極推動區域貿易協定之訂定,以消弭區域內之貿易障礙並促進區域整合。同時,貿易便捷化相關措施於國際貿易上之重要性也日漸提升,因其有助於促進各國貿易流通性,並能促進各國供應鏈整合。事實上,區域貿易協定中,也有許多貿易便捷化相關規定。惟在區域貿易協定下,是否提供協定成員足夠誘因,採取優惠性待遇,而使該優惠所生利益不會外溢至非協定成員國?本文以此為出發點,並以貿易便捷化措施為據進行分析。是故,本文旨在探討在《跨太平洋夥伴全面進步協定》、《美墨加協定》及《區域全面經濟夥伴協定》三項大型區域貿易協定下,各成員國是否得依據其中的貿易便捷化相關規定,對成員國或特定成員採取優惠性待遇,而排除最惠國待遇原則之適用,以加強區域協定成員採取更優惠之貿易便捷化措施之誘因,促進區域協定內成員整體利益,深化區域協定成員間之經貿關係。
    本文先分析WTO貿易便捷化協定中之貿易便捷化措施規範、以及三項大型區域貿易協定中之關務與貿易便捷化相關規範之規範性質差異,再分析於區域貿易協定中納入涉及優惠性待遇的貿易便捷化措施之可行性,包括客觀上採取優惠性待遇是否有最惠國待遇原則之適用,而使該優惠外溢至非協定成員、以及主觀上採優惠性待遇能更大化雙方利益,並討論在三個區域貿易協定之既有規定下,對成員國或特定對象採優惠性待遇之可能方式及利弊。綜合各項分析,本文認為區域貿易協定中的少數規定,可供成員據以對成員國或特定對象實施優惠性待遇,惟仍有部分於實務上實行之問題,待各國近一步協商、並訂定具體辦法解決。
    In recent years, the establishment of regional trade agreements has become increasingly prevalent, with nations actively promoting such agreements to eliminate intra-regional trade barriers and foster regional integration. Simultaneously, the importance of trade facilitation measures in international trade is increasingly recognized, as they aid in promoting the fluidity of trade among countries and enhancing supply chain integration. In fact, many trade facilitation-related provisions are found within regional trade agreements. However, do regional trade agreements provide sufficient incentives for members to adopt preferential treatment, thereby ensuring that the benefits arising from such preferences do not overflow to non-member countries? This paper begins with this question and analyzes it through the lens of trade facilitation measures.
    Specifically, this study aims to examine whether the Comprehensive and Progressive Agreement for Trans-Pacific Partnership (CPTPP), the United States-Mexico-Canada Agreement (USMCA), and the Regional Comprehensive Economic Partnership (RCEP) - three major regional trade agreements - permit member states to provide preferential treatment to member states or specific members based on their trade facilitation-related provisions. This examination seeks to understand if these agreements supersede the application of the principle of most-favored-nation treatment, with the goal of encouraging members to adopt more preferential trade facilitation measures, promoting the collective interest of members within the regional agreement, and deepening economic and trade relations among member states.
    This study first analyzes the trade facilitation measure norms in the World Trade Organization Trade Facilitation Agreement and the normative differences related to customs and trade facilitation in the three major regional trade agreements. It then evaluates the feasibility of incorporating preferential trade facilitation measures into regional trade agreements. This includes determining whether the application of most-favored-nation treatment principles is practically relevant when objectively providing preferential treatment, and whether this could result in such benefits overflowing to non-member countries. It also examines whether preferential treatment could maximize mutual benefits subjectively and discusses the potential methods and pros and cons of providing preferential treatment to member states or specific subjects under the existing provisions of the three regional trade agreements.
    In conclusion, this study believes that a few provisions in regional trade agreements allow members to provide preferential treatment to member states or specific subjects. However, there are some practical issues to be addressed, which require further negotiation and the formulation of specific solutions among countries.
