| Abstract: | 在婚姻之外，尚有人民選擇不進入婚姻，而是組成經營共同生活之二人結合關係，本文將其定義為「非婚伴侶」。現行法制下，無婚姻又無血緣關係之非婚伴侶，在財產、住居、社會福利等各項權利上相當缺乏保障，即便歷經婚姻平權運動，婚姻家庭制度之變遷，仍未改善。反而在爭取同志家庭承認之過程中，因同志運動團體採取婚姻平權路線，及司法院大法官釋字第748號解釋推崇婚姻價值之論述，可能形成欲尋求結合關係之權利保障就應進入婚姻之前提，有不利於非婚伴侶獲得權利保障之疑慮。
針對非婚伴侶在我國所面臨之困境，並欲打破關係保障與婚姻間之強烈連結，本文透過比較法研究，整理各國婚姻平權前後與非婚伴侶保障相關之社會背景、制度變遷，可知婚姻平權運動過後，關係保障仍應有婚姻外選擇之意義。又爬梳我國婚姻平權運動脈絡，最初同志運動團體對多元家庭形式之理想至聚焦婚姻平權之取捨，以及我國婚家制度所生包袱、人民不願進入婚姻之原因，加上同居、少子等趨勢，凸顯非婚伴侶獲得權利保障之需求，並探討我國創設「中間制度」保障非婚伴侶之可能論述。
就「中間制度」之建構，則分析美國相關立法建議與數州家事伴侶、法國PACS，及比利時法定同居等制度，繪製出非婚伴侶保障之優先領域，最後提出立法或修法建議。呼籲我國政府正視非婚伴侶之需求，創造與婚姻脫鉤之關係保障制度。 |
