Title:	我國專利權無效雙軌制之互動與調和--以「一事不再理」法效之詮釋為中心

Abstract:	近來，專利法進行重大修正，計畫將專利法之舉發法制朝向「爭議對審」方向調整，在程序上強化專利權效力挑戰者與專利權人就專利權無效事項之攻防主導地位，使程序之進行趨近於民事訴訟程序。在此前提上，實為檢討展望我國專利權無效雙軌制之最佳時機。本文嘗試由美國專利法之比較觀察以為借鏡，聚焦於「一事不再理」之法效，以爭議結果歧異之消弭，以及紛爭一次解決之促成為目標，對於我國專利權無效雙軌制之未來提出建議。
