    Abstract: 本文所引判決涉及建商違反建築法規定,將法定空間,擅自變更為停車位,並出售予公寓大廈區分所有權人時,其法律效力為何之問題,在社會生活中似屬常見,具有高度實務價值。法院認為自建商購得停車位,足以認定在公寓大廈之區分所有權人間成立分管契約,應取得停車位之專用權。同時,本件重要爭點在於:系爭停車位分別位於法定空間,乃不符竣工圖核定之停車位,則該分管契約是否無效?此項爭點之判斷,涉及民法第 71 條之適用。
