    Title: 從職場性騷擾案件類型探討雇主防制責任與補救措施-以新北市為例

    Abstract: 性騷擾之發生,於各種場域均有可能,其中發生於職場上之「職場性騷擾」是常見之類型。為保障性別工作權之平等,貫徹憲法消除性別歧視、促進性別地位實質平等之精神,我國制定性別工作平等法專章規定性騷擾之防治。為了更加瞭解性騷擾案件不同之態樣,與其防治時應有不同之對應方案,本研究即擬以實務上所發生之個案進行研究,分析性騷擾案件之態樣,及雇主受理申訴之後所採取之處理措施等,據此使雇主知悉何種行為或情狀構成性騷擾,進而採取有效之預防措施,並能了解受理申訴之後應採取何項處理措施,始為立即有效糾正及補救措施,俾使雇主得以有效遵守性別工作平等法第十三條規定,進而達到實質保障受害員工且積極防止職場性騷擾之目的。此外,依此研究結果作為主管機關得做為未來施政規劃或法律修改之依據。
