Abstract:	賣方出售其所精心雕琢之一尊貓頭鷹木雕予買方，價金新臺幣 1 萬元，雙方因此成立一買賣契約。雙方在買賣契約中約定，該新臺幣 1 萬元之價金不包含運費，賣方亦不負擔運送義務。惟買方卻指示賣方將該尊貓頭鷹木雕交由任一貨運公司運送至買方在臺北之住所。賣方因此將該尊貓頭鷹木雕交由貨運公司運送至買方之住所。不料，於運送途中，因貨運公司所僱用貨運司機之疏失，在高速公路上發生重大車禍，以致該尊貓頭鷹木雕完全毀損而無法修復，因此賠償賣方新臺幣 1 萬元。本文以此案例探討賣方買方間法律關係。
