    Abstract: 環顧歐盟與美國相關著作權司法實務對於數位介質之著作重製物,包括電腦軟體重製物與電子書重製物,在權利耗盡的議題,實有不同之發展,回頭反省我國著作權法相關規範時,相關議題未來亦可能在我國司法實務成型。到時,法院將會面臨究竟我國著作權法之權利耗盡原則是否適用於電子書,以及如何適用的難題。本文有鑑於此,由 Tom Kabinet 案之檢討出發,除辨析我國著作權法關於散布與公開傳輸等行為之定性與構成要件不同外,更進一步,依對價平衡之法理,以電子書重製物為例,論證數位著作重製物,不區分電腦軟體或電子書,應可適用我國著作權法之權利耗盡原則。
