    摘要: 因為不動產買賣價格高昂所以常常是有心的詐騙人士覬覦的對象,然而過去台灣並未針對相關詐騙的案例訂定出可以杜絕詐騙的不動產專法,幸賴相關不動產仲介經紀業者從國外引進「付款中間人」制度(Escrow),由建築經理業於買賣雙方間擔任公正第三方之角色,且該制度經歷產業界二十幾年間的調整與改良,從而發展出一套適合於台灣不動產交易現況之成屋履約保證制度。
    本研究透過相關文獻的整理以及本人從事不動產相關工作十五年的實務經驗,歸納出不動產買賣流程中的風險問題與信任問題,並透過與不動產實務界之經營者與公會代表之訪談,印證了成屋履約保證制度確實對於不動產交易安全之維護有著顯著的功效。雖說本研究結果顯示成屋履約保證制度於目前台灣不動產買賣過程中有其必要性,但其中仍尚有不完整之處,因此本研究建議應就不動產買賣交易訂立專法、修正「電子支付機構管理條例」、成屋買賣強制辦理「價金信託履約保證」機制、研擬納入「產權保險」機制及盡速通過「建築經理業管理條例」等五點,作為立法者參考之依據,使整體之不動產交易安全更加完善。
    Because of the high price of real estate sales so often have the object of a willing fraudster, but in the past Taiwan has not for the case of related fraud to make a real estate law can eliminate fraud, fortunately rely on the relevant real estate intermediary brokers from abroad to introduce" The payment intermediary system (Escrow), in which the construction manager takes on an impartial third-party role between buyers and sellers, has under been adjusted and improved by the industry over the past two decades to develop a performance guarantee system suitable for the status of real estate transactions in Taiwan.
    Through the collation of relevant literature and my 15 years of practical experience in real estate-related work, this study summarizes the risk and trust problems in the real estate transaction process, and confirms that the performance guarantee system of the real estate transaction has a remarkable effect on the maintenance of the safety of real estate transactions through interviews with the operators of the real estate practice and the representatives of the guild. Although the results of this study show that the performance guarantee system of existing houses is necessary in the current process of real estate sales in Taiwan, there are still incomplete points in them, so this study suggests that there should be a special law on real estate transactions, amendments to the "Electronic Payment Institutions Regulations", compulsory handling of "price trust performance guarantee" mechanism, the development of the inclusion of "property rights insurance" mechanism and the speedy adoption of the "Building Managers Management Ordinance" as a whole, as a reference for legislators to improve the overall basis for real estate transactions.
