| Abstract: | 我國國土計畫法於105年5月1日公告施行，空間規劃理念納入資源保育概念及永續發展之目標，依據土地資源特性劃設國土保育地區、海洋資源地區、農業發展地區及城鄉發展地區四大功能分區，並透過國土保育地區土地使用管制落實資源保育及國土復育之理念。
國土保育地區之劃設以限制發展為架構進行，朝向資源保育為主，台灣為山多平原少的島嶼約74%為山坡地面積，可利用的土地資源非常有限，加上工商發展、經濟活動改變後，促使都市土地價格飆漲，許多山坡地土地已被開發使用且位屬災害及資源利用敏感之環境敏感地區，其未來被劃入國土保育地區，將產生資源保育與土地利用間之衝突。
本研究係為探討國土保育地區如何兼顧資源保育與土地利用，以清境地區為案例，透過空間數值圖檔套疊環境敏感地區，以釐清該地區可發展、條件發展及限制發展區。研究結果發現清境地區部分土地仍具發展潛力，並以第二章理論基礎為立論點，及參考德國、荷蘭實際案例，提出未來國土保育地區下清境地區適宜之土地使用模式。進而利用上述案例研究結果，對於國土保育地區土地使用管制提出可行之建議。
The Spatial Planning Act is enacted and promulgated on May 1st, 2016. It includes the concept and goals for conservation, utilization, and sustainable development of resources. The Act demarcates the land resources into four functional zones: environmental conservation zones, marine resource zones, agricultural development zones, and urban-rural development zones. Land-use control is used to implement and fulfill the environmental conservation zoning, to achieve the conservation, utilization and management of the land.
Basic frame of the environmental conservation zone is to restrict development for conserving resources. Meanwhile, as an island covered with only 26% of lands in plains and the rests are hills, Taiwan has very limited land resources. Urban land prices have been escalating due to economic development and industry evolution. Further, a lot of hillside overlapping with environment sensitive area, including resources utilization or disaster sensitive area, have been developed for use. These hillside areas will be demarcated into environmental conservation zone under Spatial Planning Ace. It is foreseeable to induct confliction between resources conservation and land use.
This research is taking Qingjing area of Nantou Country as the case study to understand the land-use control for the environmental conservation zone under Spatial Planning act. By overlapping GIS space value map with environmental sensitive area map to decide the developable, conditioned development, and restricted development areas in the region. The study finds partial lands in Qingjing area are still full of developmental potential. Utilizing the literature review as the foundation and referencing case studies in Netherland and Germany, this study presents the optimal land-use mode in Qingjing area. Recommendations to land-use control for the environmental conversation zone based upon the study are drawn for future references. |
