摘要:	國內近來有人認為，就我國申請參與聯合國一事，可否主張中共乃是「爭端當事國」，因而根據憲章第二十七條第三項但書之規定，中共就我國申請參與聯合國一事，為爭端當事國，因而不可投票。然從過去聯合國之實踐發現，安理會會員國於是否有「強制棄權條款」之適用情形時，通常會主張「繫爭事項」(Matter in dispute)乃是「情勢」(situation)而非「爭端」(dispute)，或主張其並非「爭端當事國」(parties to Disputers)，或是主張該事項並非第六章，或第五十二條第三項內之決議，故而其並無不得投票之義務，又其實踐發現，憲章第二章之相關決議，並非強制棄權條款之所及。
