    Abstract: 法國第五共合與我國現行憲政設計均被視為「雙首長制」。面對立法院生態日趨多元、各政黨勢力快速消長,又即將產生第一位民選總統之際,會否發生總統與立院多數分屬不同政治流派的狀況,及在此一狀況下總統必須提名不同政治取向的行政院長,兩者的權力將如何分享與互動,均頗受各界關注。而在一九八六年至一九八八、及一九九三至一九九五年間,法國早已兩度經歷左右派政治人物分居總統與總理職位的「共治」狀態。由其經濟所累積之心得,對我國即將面臨的憲政發展問題,顯然有具有高度參考價值。本文在檢視法國的「共治」經驗後,發現不同政治取向的總統與總理「共治」,並非如一般所預想像的難以調和,但也引發若干關於我國憲政應該加以通盤檢討與再規劃的思考。」
