    Abstract: 金融科技(FinTech)近年來在金融領域成為顯學,原因在於新興科技為傳統金融機構的服務帶來顛覆性的效果。在金融科技與保險科技的浪潮下,台灣金融業者紛紛著手發展創新金融服務。而金融創新背後需有主管機關的支持與法規的核可才能順利實施運行,但過去台灣監理法規在立法、修法效率遲緩,在因應保險科技即時、快速的步調上,傳統監理模式將在保險科技趨勢下面臨困難與挑戰。又主管機關與業者過往上下位之從屬關係對於由下向上發動創新的推動有一定阻礙。保險業面臨創新法規修正的困境該如何突破,是本文的研究重點。
    研究發現,保險業的創新法規過去多仰賴保險同業公會作為業者與監理機構的運作樞紐,然而在金融科技趨勢下此合作模式會有所改變。本文認為公私協力的新溝通模式可視為現行法規調整困境的突破關鍵,業者可透過公私協力概念排除從屬關係,與金融監理機構平等溝通創新方案,以充分獲得監理機構的理解與支持。並定義公私協力之概念為,業者、監理機構與獨立專業機構三方以平等互惠、共同參與、責任劃分的形式面對金融科技創新。本文認為,公私協力的精神是監理沙盒運行的核心要素,亦是此親晤親簽科技替代方案溝通的成功要點,故倡議公私協力可為金融科技業者善加利用。
    本文在個案研析中有三點發現:其一,保險業者除採以往常見由上而下的溝通模式外,亦可採逐級而上的溝通形式增加保險科技創新服務落地的可能。其二,本個案非以壽險公會作為保險業者與主管機關溝通樞紐,而是以學術機構金融科技研究中心作為溝通樞紐,視為傳統保險法規調整框架的突破。其三,公正第三方機構作為提案溝通樞紐,其與各相關單位無利益衝突,其效益等同於監理沙盒,可充分發揮公私協力的精神。
    FinTech has become a prominent scholar in financial sector recently. Potential of new innovations have had a disruptive effect on traditional financial sectors. With the innovative trend of FinTech and InsurTech, Taiwanese financial industry leaders and innovators have begun to develop innovative financial services. New financial products and services are creating significant regulatory uncertainty. The financial innovators require the support from relevant authorities and the approval of the regulations to be able to operate legally. However, in the past, Taiwan’s supervision regulations were slow in legislation and law enforcement. Besides, the subordinate relationship between supervisory authorities and the industry impeded innovation from the bottom up. In response to the rapid pace of InsurTech, the traditional pattern on regulatory revision needs to change. Facing difficulties and challenges under the trend, this paper would focus on how to break through the dilemma between the slow adjustment of innovation regulations and rapid pace of FinTech and InsurTech.
    This study found that regulations with innovation in insurance used to rely on the insurance industry association as the key bridge of the insurance companies and supervision institutions. However, this cooperation pattern is changing under the impact of financial technology. The new communication pattern, Public-Private Partnership, can be regarded as the solution to the current regulatory adjustment inconsistency. This paper believes that the Public-Private Partnership is the core element of Regulatory Sandbox and the case, R&D Smart-See-Signature alternative.
    In this paper, there are three points in the case study: First, in addition to the common top-down communication model, the bottom-up communication form.
    This paper takes the R&D Smart-See-Signature alternative in insurance as a case study. This case breaks through the traditional insurance regulatory adjustment framework with the idea of Public-Private Partnership.
