    Abstract: 旅館業的智慧財產保護主要為商標權，包括廣義的品牌、形象等等。根據商標法第18條第1項，「商標，指任何具有識別性之標識，得以文字、圖形、記號、顏色、立體形狀、動態、全像圖、聲音等，或其聯合式所組成」。常見的旅館業商標，例如雅緹汽車旅館的「AT NIGHT」商標（註冊號01765970，如圖1a）、福華大飯店的「福華大飯店台北／PLAZA HOTEL TAIPEI」商標（註冊號01626094，如圖1b）等，其多為文字、圖形、記號或其組合而作為商標圖樣的內容。
