    Abstract: 專利法制之健全發展除須依賴立法者睿智的前瞻觀察及回顧反省外,尚賴司法實務對於既成法下利益衝突中給予明確的價值判斷及利益衡量,以建立最適的詮釋。專利侵害均等論及禁反言原則為專利法之基本法理,其形成及實踐在歐美各專利法先進國家均有其特殊的發展方式及成果,值得我國法加以借鏡。雖然我國法不能自外於國際專利法和諧化之趨勢而對於專利侵害均等論及禁反言原則予以拒卻,但就我國專利法制而言,真正存在的問題是如何將專利侵害均等論及禁反言原則置入我國專利法體系而使之合理運作。
