    Abstract: 凱爾生在第一次世界大戰後發表的政治論文,可說和純粹法學具有內在關聯。在此脈絡下,法的位階架構理論可以理解為民主主義意志的法體系理論。換言之,凱爾生的民主主義具有如下意義:將純粹法學進一步建構為「議會民主主義的法理論」。這樣的法理論,正適合凱爾生起草的奧地利共和國憲法。相對於此,埃利希的法理論則可理解為「司法上法形成的法理論」。在當代東亞法律發展上,議會的立法與司法的法形成正複雜交錯著。上述的二種法理論,有助於理解東亞法律發展的情況。
