    Abstract: 本文從我國第一個獨立的通訊傳播管制機關NCC的立法與政治現實切入,探究在管制監理性格的定位,以及以執照管理與處罰等限制性政策工具為主要手段的狀況下,該機構如何能達成其成立宗旨中「促進通訊傳播健全發展」和「促進多元文化均衡發展」等兩個正向目標。本文認為,在輔導廣電媒體產業方面,NCC可以透過所有權的管理和分配,形成一個較為健全的媒體環境,同時對於取得執照之業者,也可課以一定的公共義務負擔,特別是引導資金投注於文化產品的實質生產。其次,NCC亦可透過多樣性媒體的規劃,以及保障弱勢群體的近用媒體權利,再輔以公開、透明、民主的內容管制程序,促進蓬勃的多元文化發展。
    Taiwan’s first independent communications regulator, National Communications Commission (NCC), was basically a supervisory body mainly with restrictive regulation measures. The paper aims to explore that in the circumstance how NCC can fulfill two positive goals in its mandate: promoting communications industries and cultural diversities. The paper concludes firstly that NCC can use the licensing procedure to set up a plural media environment and to require applicant obligations in supporting domestic media production. Secondly, NCC can plan to diversify media structures and options and to take transparent and democratic content regulation measures to promoting cultural diversity.
