    Abstract: 自從網際網路商業化後, 隨著全球與各國網路基礎設施完備, 網路經濟全球化已經成為趨勢, 而規範網路與電子商務的法律也同樣為國際組織與各國所重視, 導致網路法成為一新法律領域. 中共自經濟改革開放後,西方市場經濟與法治思想即不斷衝擊有關馬克思主義法學, 網路科技, 經濟與法律的辯證關係也開始受到重視. 本文審視中共在網路經濟全球化以來有關網路立法的構成及法律基礎, 探討中共發展網路法制的正當性理論,檢討馬克思的政治經濟分析, 以及有關中國特色社會主義的法學詮釋, 企圖於中共網路立法的理論與實際之間, 發現馬克思主義中國特色化的侷限, 並且也認為中共在經濟接軌, 法制移植之後, 極可能使中國特色社會主義的法學任務僅存形骸,而開始有了一種[中國特色資本主義法學]的隱喻.
    With the advancement of a world wide network infrastructure, the globalization of Internet economies has become inevitable since the commercialization of internet services. Accordingly, Cyber Law, which regulates the Internet and electronic businesses has become a new legal domain of primarily concerned intenational organizations and nations. In China, the Western concepts of market economy and the rule of law have been struggling with Marxist principles after the reform movement, including its open economic policies. The arguments among cyber technologies, laws, and the economy are highlighted in this austere situatiobn. This article aims to probe the Chinese legislation and the legal foundation of its Cyber Law regarding the globalization of Internet economy, to investigate the legitimacy of Chinese Communist Party`s development of Cyber Laws, and to review Marx`s analyses of politics and economy as well as to comment on the legal annotation of the socialism with Chinese characteristics. In other words, this study not only manages to reveal certain limitations of Marxism with Chinese characteristics but also connotes that the jurisprudence of the so-called socialism with Chinese Characteristics merely leaves a Marxist skeleton with a jurisprudence of "the Chinese Characteristic Capitalism" inside it. The result shows a fact that it has followed the Chinese Communist Party`s experiences in the process of the economic adaptation and the transplantation of the rule of law.
