    Abstract: 英美法保險代位之概念,對我國而言原較為陌生。近年我國漸有學說加以引介,並大致上認為有理論一貫、增進求償效率等優點。亦有學說對其加以評論,認為英美法之學說不論是在價值判斷、法理結構、乃至於實際的效果上,都有謬誤或缺陷,並不可採。本文乃嘗試分析學說對英美保險代位之正反見解,並對英美法之架構加以釐清。本文以為,我國法之架構應否或如何修正,在立法政策上應有討論之空間;又不論立法政策之選擇為何,吾人若能對英美法之概念有較為正確之認識,則至少對於保險法學理之發展、以及若干實務運作方式之釐清,均應當有所助益。
