    摘要: 程度、水位或水平意味一種可上下調節的浮動狀態。德國學說與實務討論民主正當性問題上,使用正當性程度(Legitimationsniveau)一詞,以說明民主正當性所應到程度的變化無常,不拘泥於特定模式。目前中、外文獻對於民主正當性已有相當探討,本文試圖將正當性程度從民主正當性中抽離出來,作為型塑正當化的規範與實際。
    The decentralization of administrative power is not a novel phenomenon in the modern state. The Principle of Democracy does not demand the maximum level of democratic legitimation for decisionmaking, but rather a sufficient level of legitimation. The sequence of responsibility may be created in various ways, and not just in a single specific way. The crucial factor is that a sufficient proportion of democratic legitimation, or a specific level of legitimation, is achieved. The adequate level of legitimacy could be a balance of functional, institutional, personnel and material elements of legitimation. This paper tries to analyze the conception of „level of democratic legitimacy,“ which was developed by E. W. Böckenförde and the judgment of the German Constitutional Court. Several modes of democratic legitimation have been discussed.
