    Abstract: 學校是保障教育基本權核心的主要場所。因此，學校須給予學生學習的權益並保障學生能安全接受教育。身為保障教育基本權實現的參與者，父母的教育權應以其子女的自我實現為導向，如學校影響學生的自我實現時，父母得行使異議權，並得拒絕之；教師從事教育活動時，負有保障學生生命、身體安全的保持與注意義務；學校為保護學生的安全教育環境，須具體形成或整備完善的學校設備、學校環境等教育外在條件。當學校事故發生，表示學生安全受教育的權利已被侵害，此時最重要的即是賠償責任是否成立。本文藉由以玻璃娃娃判決為例，探討學校事故的國家賠償責任，並肯認本案中體育教師有作為公務員的國家賠償責任；而私立景文高中學校設施因非屬於公有公共設施，僅負民事上的侵權行為責任。
    The school is the main place that protects the power core of the fundamental right to education. Therefore, the school must provide a student the right of learning and ensure a safe educational environment. As participants who ensure the fundamental right to education and guarantee the education, the parents should focus on children’s self-fulfillment; if the school influences a student`s self-realization, parents have to exercise their power to object, to the influences. When teachers engage in educational activities, they have to remain aware of the life and bodily security of each student. In order to protect the student`s educational environment, the school must concretely provide proper school equipment, school environment...etc. When accidents in school take place, the student`s security and educational right may have already been violated; at this time, the most important thing is to compensate the victim whether the responsibility is established or not. This study takes the civil adjudication in the Taiwan High Court as an example to confer state compensatory liability in cases of school accidents, and confirms that teachers of physical education have to be responsible for state compensatory of being a public official; facilities in private senior high schools, however, do not belong to the obligated organization of compensation; it only incurs the responsibility of infringement behavior of the civil case.
