    Abstract: 人本思考,是以人為中心,對主體趨向客體的意向、行為和價值關係的研究。韋爾策爾(Welzel)超脫學派之爭,借鑑並超越價值哲學,以個體人為中心對犯罪論各階段進行細緻的研究。其人本探索以個體人「自治」為出發點,以規範價值為核心,以目的支配為靈魂。本體行為,係其刑法理論優先考慮的問題,基於個體支配,具有目的性與因果性特徵,包含主客觀方面的因素,貫穿存在與價值的內容。人的不法,取決於個體的行為目標、觀念和義務,即行為無價值,無關法益侵害,過失犯也不例外。責任,係因行為人能放棄但未放棄違法行為,而對其所進行的人格非難,具有人類學、性格心理學和人格決定之基礎。違法性意識乃責任非難之依據,欠缺違法性意識的可能性,可排除責任。韋爾策爾的人本刑法探索,是以個體為中心而對犯罪行為所進行的考察,奉構成要件為圭臬,內在以主體目的為支配,以行為無價值、人格責任為刑法評價的主要內容,融合主客觀方面以維護研究之整體性,貫穿價值思考以度時勢之變。刑法的人本思考,於當代刑法研究有重要意義。
    Person-oriented Theory studies the intention, act and value relation of the subjective tendency to object. Welzel’s thoughts on criminal law surmount theoretical arguments, make the value in law take on the fea-ture of person, borrow ideas from, and go beyond, value philosophy and carry on more careful research at each stage of criminal theory with the focus on person. His thought takes the autonomy of person as a starting point, the value of law as its heart and the steering of intention as its soul. The problem of ontological behavior takes top priority in criminal law, has the features of the steering of intention and causality, contains subjective and objective constituents and combines ontological structure and value. Person-oriented illegality, i.e., invalidity of conduct, which bears no relation to legal interests violation, even if negligence is included, is decided by goal, idea and personal obligation. Who may possibly give up but does not give up illegal behavior, will shoulder the responsibility because of his personal conduct, and because of anthro-pological and psychological bases and determination of per¬sonality. Il-legal consciousness is the standard for the valuation of responsibility. Without the possibility of illegal consciousness, respon¬sibility could be exempted. Welzel’s person-oriented theory in criminal law is the overall view of criminal behavior on the basis of the steerage of person. It takes ac-tus reus as the standard of crime, and the steering of subject intention as ontological substance, invalidity of conduct and personal responsibility as main content. All of these have fused subjective and objective as-pects in order to maintain an integrated study, examined through the concept of value in order to solve actual problems. Welzel’s ideas on criminal law have significance for the study of contemporary criminal law.
