    Abstract: 我國採購法並未特別對計算錯誤有所規範,而僅有第五十八條標價偏低相關規定之設。採購法實務上,無論決標爭議或停權爭議,幾無不集中在是否有「顯不合理,有降低品質、不能誠信履約之虞或其他特殊情形」之判斷上,且考量之觀點均為採購法採購秩序之維護,並未同時設身處地為廠商之處境著想,更未同時審酌廠商在民法所處之地位。即使在政府採購爭議案件之處理上,也不應完全站在採購機關之立場,採購秩序之建立及公平競爭環境之維護亦需斟酌民法對計算錯誤之法律判斷及一般法律原則,特別是誠實信用原則、權利濫用禁止原則之適用。
    The Government Procurement Act of our country does not regulate “an error of computation”, and there is only a single regulation about excessively low offered prices in Article 58. From a juridical perspective, the key point of the dispute about “the award of contract” or “the prohibition of participating in tendering” is the judgment on the price which evidently appears to be unreasonable, the quality of performance which is likely to be impaired, the contract which is not likely to be performed in good faith, or any other extraordinary situations. Furthermore, all considerations of the judgment are how to keep order of procurement. They do not concern the interest of tenderers, nor is the position of tenderers taken into account in civil law. Even when dealing with disputes about government procurement, we should not absolutely favor entities. Establishing procurement order and a fair competitive environment should take account of the rule of “an error of computation” in civil law and the general principles of law, especially the principle of good faith and the principle of profiting from misuse.
