    Abstract: 日本人類胚胎幹細胞研究的管制與時並進。「ES細胞指針」、人複製胚研究是否開放以及開放的幅度、甚至人工多能細胞引發的倫理問題皆為反省課題。為了均衡管制的明確性與彈性,日本政府作了特殊的管制選擇,「ES細胞指針」雖無法律授權,仍可作為政府補助幹細胞研究的依據。「複製技術規制法」二○○六年底制訂,「特定胚指針」於隔年公布。儘管九種特定胚的法律定義非一般人所能理解,日本政府在功利主義上置入人性尊嚴,建立起具有日本特色的胚胎尊重模型。二重審查機制固然阻礙了研究的效率,同時也避免韓國過渡強調研究效用,而輕忽倫理與法律問題的弊病。我國在大膽開放幹細胞研究範圍之後,可以從日本習得如何建立符合自身需求的管制體系。
    The regulation of embryonic stem cell research in Japan pro¬gresses with time. Under steady scrutiny are the issues surrounding the derivation and utilization of human embryonic stem cells, therapeutic cloning and induced pluripotent cells. Japan combines laws and guidelines to make a unique regulatory choice. Government funding is based on the ES cells Guidelines without legal authorization. “The Law Concerning Regulation Relating to Human Cloning Techniques” was promulgated at the end of the year 2000, and after one year “the Guidelines for Handling of a Specified Embryo”. The legal definition of a specified embryo is incomprehensible to lay persons. Nonetheless, Japan has established a functional embryo respect model which mixes utilitarianism and human dignity. The double check review process takes far longer to approve research projects on human embryonic stem cells than review processes in other countries. Meanwhile, it can prevent an occurrence of the Hwang Woo-Suk affair from taking place in Japan. After liberalizing research cloning, Taiwan has much to learn from the Japanese rigorous oversight mechanism.
